ELEXBIG Intellectual Property & Takedown Policy

Operator: ELEXBIG (“ELEXBIG”, “we”, “us”, “our”)

ELEXBIG respects intellectual property rights and expects all Sellers, Buyers, brands, rights holders, and other users of our marketplace to do the same.

This Intellectual Property & Takedown Policy explains how ELEXBIG handles reports of copyright, trade mark, design, and other intellectual property infringement involving content, products, images, listings, stores, or other materials made available through the ELEXBIG marketplace.

This policy is intended to operate consistently with applicable Nigerian intellectual property laws, including the Copyright Act 2022, and other applicable laws relating to trade marks, designs, patents, passing off, counterfeit goods, and unfair or misleading commercial practices.

It also supplements ELEXBIG's Terms and Conditions, Seller Policy & Code of Conduct, Community Guidelines, Prohibited Items Policy, Authentic Items Policy, and other applicable marketplace policies.

 

1. Overview

1.1

If you are a copyright owner, trade mark owner, design or other intellectual property rights holder, or an authorised representative of a rights holder, and you believe that content or a product listing on ELEXBIG infringes your intellectual property rights, you may submit an intellectual property takedown notice to us as described in this policy.

1.2

This policy may apply to reports involving:

  • Copyright infringement, including unauthorised use of photographs, product images, videos, text, graphics, software, music, or other protected works.
  • Trade mark infringement, including unauthorised use of protected brand names, logos, marks, or other identifiers.
  • Counterfeit or unauthorised products.
  • Unauthorised use of brand or product materials.
  • Design-right infringement, where applicable.
  • Patent-related infringement, where applicable.
  • Passing off or other misleading conduct involving another business, brand, product, or intellectual property.
  • Other conduct that may unlawfully interfere with the intellectual property rights of another person or organisation.

1.3

A person submitting an intellectual property notice must have a genuine and good-faith basis for believing that infringement has occurred.

False, fraudulent, abusive, or deliberately misleading notices may result in the rejection of the complaint, account restrictions, suspension or termination, and may expose the person submitting the notice to legal consequences.

 

2. How to Submit an Intellectual Property Takedown Notice

Required Information

2.2

To help us process an intellectual property complaint efficiently, the notice should include:

  • Your identity: Your full name or the name of the rights holder you represent.
  • Contact information: A valid email address, telephone number, and contact or postal address where reasonably required.
  • Authority to act: If you are acting for another person or organisation, evidence or an explanation of your authority to act on behalf of the rights holder.
  • Identification of the intellectual property: A clear description of the copyright work, trade mark, design, patent, brand asset, or other intellectual property allegedly affected.
  • Evidence of rights: Where available, relevant registration details, certificates, original files, ownership information, licensing information, or other evidence supporting the claim.
  • Identification of the allegedly infringing material: The specific product, listing, image, text, video, store, account, or other content alleged to infringe the right.
  • URL or location: The specific ELEXBIG product or page URL, where available, so that we can locate the material.
  • Explanation of the alleged infringement: A clear explanation of why the content or product allegedly infringes your rights.
  • Good-faith statement: A statement confirming that you genuinely believe the use complained of is not authorised by the rights holder, an authorised representative, or applicable law.
  • Accuracy and authority statement: Confirmation that the information supplied is accurate and, where applicable, that you are authorised to act for the rights holder.
  • Signature: A physical or electronic signature where appropriate.

2.3

For copyright takedown notices, ELEXBIG may request information required under the applicable online infringement provisions of the Copyright Act 2022, including identification of the protected work, identification and location of the allegedly infringing material, contact information, an appropriate declaration regarding the alleged unauthorised use, and confirmation that the complainant is authorised to act.

2.4

Incomplete notices may delay our review. ELEXBIG may request additional information or documentation where necessary.

 

3. ELEXBIG's Response

3.1

After receiving an intellectual property complaint, ELEXBIG may:

  • Acknowledge receipt of the complaint.
  • Review the information provided.
  • Assess whether the complaint appears credible and sufficiently supported.
  • Identify the relevant Seller, listing, content, or account.
  • Request additional information from the complainant or Seller.
  • Temporarily restrict, hide, remove, or disable access to allegedly infringing content where appropriate.
  • Notify the affected Seller or user of the complaint, subject to applicable law and operational considerations.
  • Request proof of ownership, authorisation, authenticity, licensing, distribution rights, or other relevant documentation.
  • Take appropriate enforcement action where infringement is established or reasonably suspected.
  • Refer serious matters to appropriate authorities or rights-enforcement bodies where appropriate.

3.2

Under the Nigerian Copyright Act 2022, a copyright owner may issue a written infringement notice to a relevant service provider requesting that infringing content or a link to such content be taken down or access disabled. The Act also sets out requirements for such notices and the handling of counter-notices.

3.3

ELEXBIG will seek to review complete complaints as promptly as reasonably practicable. The timeframe may vary depending on the complexity of the complaint, the amount of evidence provided, whether the Seller responds, and whether the matter requires specialist or legal review.

3.4

A complaint does not automatically establish that infringement has occurred. ELEXBIG may consider information from both the complainant and the affected Seller before making a final platform decision where circumstances permit.

3.5

Nothing in this policy prevents ELEXBIG from taking immediate action where necessary to protect customers, rights holders, Sellers, the marketplace, or the public from potentially counterfeit, unlawful, unsafe, fraudulent, or seriously infringing activity.

 

4. Counter-Notice and Seller Response

4.1

If a Seller believes that content has been removed or restricted in error, the Seller may contact ELEXBIG and provide a response or counter-notice.

Examples include circumstances where:

  • The Seller owns the relevant intellectual property.
  • The Seller has a valid licence or authorisation.
  • The Seller has permission from the rights holder.
  • The product is genuine and lawfully supplied.
  • The material was incorrectly identified.
  • The complaint contains inaccurate or incomplete information.
  • The Seller believes the use is otherwise authorised or permitted by applicable law.

4.2

A Seller response should include:

  • The Seller's full name or business name.
  • Contact details.
  • Identification of the affected product, listing, image, or content.
  • The relevant URL or listing reference, where available.
  • An explanation of why the Seller believes the complaint is incorrect or the use is authorised.
  • Evidence of ownership, licensing, authorisation, distribution rights, purchase documentation, or authenticity where relevant.
  • Any other information that may assist ELEXBIG in reviewing the matter.

4.3

Where the matter concerns copyright and falls within the online infringement provisions of the Copyright Act 2022, ELEXBIG may handle a counter-notice in accordance with the applicable statutory framework.

The Copyright Act provides a process under which a service provider may restore content after receiving a written counter-notice that has been forwarded to the copyright owner, subject to the statutory requirements and response period.

4.4

Where restoration is permitted or undertaken, restoration does not necessarily mean that ELEXBIG has determined that no infringement occurred. The parties may retain rights to pursue appropriate legal remedies.

 

5. Repeat Infringement Policy

5.1

ELEXBIG may take progressively stronger action against Sellers or users who repeatedly engage in confirmed intellectual property infringement.

Possible actions include:

First confirmed infringement:

  • Removal or restriction of the infringing content.
  • Warning or educational notice.
  • Requirement to correct the listing or content.

Second confirmed infringement:

  • Removal of the infringing content.
  • Formal warning.
  • Temporary account or listing restrictions.
  • Requirement to provide evidence of compliance or an undertaking where appropriate.

Further or repeated confirmed infringement:

  • Suspension of listings or account.
  • Restriction of selling privileges.
  • Termination of the Seller account.
  • Other appropriate enforcement measures.

5.2

ELEXBIG may bypass progressive warnings where the conduct is serious, deliberate, fraudulent, commercial in scale, or presents a significant risk.

Examples include:

  • Selling counterfeit products.
  • Operating a business primarily through counterfeit or unauthorised goods.
  • Deliberately copying another brand's identity.
  • Repeatedly uploading stolen photographs or other protected materials after warnings.
  • Circumventing previous enforcement actions.
  • Providing fraudulent documents to establish authenticity or authorisation.

5.3

Intellectual property violations may be recorded against an account and may be considered when ELEXBIG evaluates future selling privileges, verification, account restrictions, or reinstatement requests.

 

6. Counterfeit and Unauthorised Products

6.1

ELEXBIG prohibits Sellers from listing or selling counterfeit, fake, pirated, unlawfully reproduced, stolen, or otherwise unauthorised products.

6.2

Sellers must not:

  • Represent counterfeit goods as genuine.
  • Use another brand's name or logo in a misleading manner.
  • Use stolen product photographs or descriptions without permission.
  • Claim to be an authorised distributor when they are not.
  • Use another business's identity to create confusion.
  • Upload product materials obtained without appropriate permission.
  • Circumvent ELEXBIG's authenticity or verification requirements.

6.3

ELEXBIG may request evidence of authenticity, purchase, distribution, authorisation, or lawful sourcing where a product or listing is reported.

6.4

Where counterfeit or seriously infringing activity is suspected, ELEXBIG may immediately restrict or remove the listing while the matter is investigated.

 

7. Intellectual Property and Seller Responsibilities

Sellers are responsible for ensuring that the products, photographs, descriptions, videos, logos, graphics, software, documents, and other materials they upload or provide to ELEXBIG do not unlawfully infringe another person's intellectual property rights.

Before uploading content, Sellers should ensure that they:

  • Own the content; or
  • Have obtained appropriate permission or a licence to use it; or
  • Are otherwise legally entitled to use it.

Sellers should retain relevant licences, invoices, distribution agreements, authorisation letters, and other evidence that may demonstrate their right to sell or advertise particular products or use particular intellectual property.

 

8. Reporting Misuse of ELEXBIG Content

8.1

ELEXBIG also protects intellectual property belonging to ELEXBIG and its authorised partners.

Users and third parties must not copy, reproduce, scrape, modify, republish, distribute, or commercially exploit ELEXBIG's website content, branding, graphics, photographs, written materials, software, or other protected materials without appropriate authorisation, except where permitted by applicable law.

9. Legal Framework

9.1

This policy is intended to operate in accordance with applicable Nigerian laws, including, where applicable:

  • Copyright Act 2022 — provides the principal statutory framework for copyright protection in Nigeria and includes specific provisions addressing online content and copyright infringement notices and takedowns.
  • Trade Marks Act and applicable Nigerian trade mark regulations and procedures.
  • Patents and Designs Act, as applicable.
  • Applicable laws concerning passing off, counterfeit goods, fraud, consumer protection, and misleading commercial practices.
  • Other applicable Nigerian intellectual property laws and regulations.

9.2

The Nigerian Copyright Act 2022 specifically provides an online notice-and-takedown framework. Section 54 sets out information to be included in a copyright infringement notification, while section 55 addresses notification to the subscriber and takedown or disabling of access to infringing content.

9.3

The Nigerian Copyright Commission also has statutory powers relating to online infringing content, including powers under the Copyright Act concerning blocking or disabling access to content, links, or websites reasonably believed to infringe copyright.

9.4

Nothing in this policy limits any rights, remedies, defences, exceptions, or procedures available to intellectual property owners, Sellers, users, or other persons under applicable Nigerian law.

 

10. Cooperation With Authorities

ELEXBIG may cooperate with the Nigerian Copyright Commission, law enforcement agencies, courts, regulators, rights holders, and other competent authorities where legally required or reasonably necessary to investigate or prevent intellectual property infringement, counterfeit activity, fraud, piracy, or other unlawful conduct.

Where appropriate, ELEXBIG may preserve relevant records or information in accordance with applicable law and its Privacy Policy.

 

11. Changes to This Policy

ELEXBIG may update this Intellectual Property & Takedown Policy from time to time to reflect changes to our marketplace, applicable laws, enforcement practices, or intellectual property procedures.

The updated version will be published on ELEXBIG and will include a revised "Last updated" date.
